1. Service Description

RegPulse ("the Service") is an AI-powered regulatory monitoring platform operated by Rogach Enterprises ("we", "us", "our"), a company registered in Belgium. The Service aggregates publicly available regulatory information and uses artificial intelligence to classify, summarize, and alert users about regulatory developments.

1.1 Nature of the Service

The Service is an information aggregation and monitoring tool. It is not a legal service, compliance consultancy, or professional advisory firm. The Service:

Collects and organizes publicly available regulatory information
Uses AI to generate summaries, classifications, and impact assessments
Delivers alerts based on user-configured preferences
Does NOT provide legal opinions, compliance certifications, or professional advice

1.2 AI-Generated Content

All severity classifications, impact scores, confidence ratings, and summaries are generated by artificial intelligence and are estimates only. These AI assessments:

May contain errors, omissions, or misclassifications
Are not substitutes for professional legal or compliance analysis
Should be independently verified before any action is taken
Are labeled as "AI-assessed" throughout the platform

2. No Professional Advice

Nothing in the Service constitutes legal advice, compliance advice, financial advice, or any other form of professional advice. You should not rely solely on the Service for compliance decisions. Always consult with qualified legal counsel, compliance professionals, or other appropriate advisors for your specific regulatory obligations.

3. User Obligations

By using the Service, you agree to:

Independently verify all regulatory information before acting on it
Not treat AI-generated assessments as professional opinions
Maintain your own compliance programs and professional advisory relationships
Report any errors or inaccuracies you discover via our error reporting feature
Use the Service in compliance with all applicable laws and regulations
Not redistribute, resell, or republish Service content without authorization

4. Limitation of Liability

4.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, OR NON-INFRINGEMENT.

4.2 Limitation

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

4.3 Exclusion

WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO: LOSS OF PROFITS, LOSS OF DATA, REGULATORY FINES OR PENALTIES, BUSINESS INTERRUPTION, OR COSTS OF SUBSTITUTE SERVICES, REGARDLESS OF THE THEORY OF LIABILITY.

5. Indemnification

You agree to indemnify, defend, and hold harmless Rogach Enterprises, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your reliance on AI-generated content for compliance decisions.

6. Subscription and Payment

Free trials last 14 days with limited features
Paid subscriptions are billed monthly or annually
Payments are processed via Stripe; we do not store payment card details
Refunds are available within 14 days of initial purchase if the Service does not meet reasonable expectations
We may change pricing with 30 days' notice to active subscribers

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data in compliance with the General Data Protection Regulation (GDPR) and Belgian data protection law.

8. Intellectual Property

The Service, including its design, algorithms, and AI models, is our intellectual property. Regulatory content we aggregate remains the property of the issuing regulatory bodies. Our AI-generated summaries and analyses are our derivative works provided under license for your internal use only.

9. Modifications

We may modify these Terms at any time. We will provide 30 days' notice of material changes via email or in-app notification. Continued use of the Service after changes take effect constitutes acceptance of the modified Terms.

10. Termination

Either party may terminate the subscription at any time. Upon termination, your access to the Service will end at the end of the current billing period. We may immediately suspend access for violations of these Terms.

11. Force Majeure

We shall not be liable for failures or delays caused by circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, internet disruptions, third-party service outages, or changes in regulatory body publication practices.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of Belgium. Any disputes shall be submitted to the exclusive jurisdiction of the courts of Brussels, Belgium. For consumers within the EU, this does not affect your right to bring proceedings in your country of residence.

13. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall continue in full force and effect.
